1. Introduction
Welcome to MutualAccessSpace ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at mutualaccessspace.sbs (the "Service") operated by MutualAccessSpace.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
MutualAccessSpace offers an array of exclusive yacht charter services, which includes:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All services are contingent on availability and favorable weather conditions. We maintain the right to alter or halt services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, one must:
- Be at least 18 years old
- Submit accurate and complete information
- Pay the necessary deposit as indicated in your booking confirmation
- Concede to these Terms & Conditions
3.2 Confirmation
A booking is deemed confirmed only after we acknowledge receipt of payment and issue a written confirmation. We reserve the right to decline service at our discretion.
3.3 Availability
All charters are subject to the availability of the vessel and suitable weather conditions. We will endeavor to accommodate your preferred dates and time slots.
4. Payment Terms
4.1 Pricing
All prices are quoted in € and are inclusive of relevant taxes unless specified otherwise. Prices are subject to change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total charter cost due at the time of booking
- Balance: Payable 48 hours before the charter departs
- Incidental charges (if applicable): Payable at the end of the charter
4.3 Payment Methods
We accept most major credit cards, bank transfers, and certified cheques. We process payments using secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full refund minus transaction fees
- Between 24-72 hours before departure: 50% refund
- Less than 24 hours before departure: No refund will be issued
5.2 Weather Cancellations
In the event the captain deems weather conditions unsafe, we will propose to:
- Reschedule the charter to another suitable date at no extra charge
- Issue a full refund if rescheduling is not an option
5.3 Mechanical Issues
Should mechanical issues arise with the designated vessel, attempts will be made to provide an appropriate replacement. If unable, a full refund will be provided.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all instructions given by the crew
- Don the provided safety gear when necessary
- Inform of any existing medical conditions that could affect safety
- Stay within the authorized areas on the vessel
6.2 Prohibited Items
The following items are not allowed on board:
- Glass containers
- Illicit drugs
- Firearms or other weapons
- Excessive quantities of non-alcoholic beverages beyond reasonable consumption
- Pets (unless pre-approved)
6.3 Conduct
Patrons are expected to behave in a courteous and respectful manner. Should passenger behavior present a safety hazard or severely disrupt the enjoyment of other guests, we reserve the right to prematurely end the charter without any refunds.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the cost paid for the charter. We will not be held accountable for:
- Injuries sustained due to passenger carelessness
- Theft or destruction of personal belongings
- Indirect, consequential, or punitive damages
- Delays occasioned by weather or events outside our reasonable control
7.2 Insurance Coverage
Comprehensive marine insurance is maintained for our vessels and operations. It is the responsibility of passengers to ensure their own travel and personal insurance coverage.
7.3 Assumption of Risk
By partaking in our charter services, you consent to the fact that nautical activities possess intrinsic dangers and you accept accountability for your personal safety and welfare.
8. Modifications and Itinerary Changes
We reserve the right to tweak itineraries, pathways, or schedules due to weather considerations, safety needs, or operational exigencies. We will strive to provide alternative experiences of equivalent value.
9. Force Majeure
We hold no responsibility for interruptions, cancellations, or alterations brought about by circumstances beyond our directive, which may include:
- Extreme weather phenomena
- Natural calamities
- Government impositions
- Port shutdowns
- Mechanical failures
10. Privacy and Data Protection
Your private data is managed according to our Privacy Policy. Utilizing our services indicates your approval of the data gathering and the mode of utilization as detailed in our Privacy Policy.
11. Intellectual Property
All content on our website, including text, visuals, trademarks, and images, are shielded by intellectual property laws. Reproduction, dissemination, or creation of derivative works are prohibited without our explicit consent.
12. Governing Law
These Terms are subject to the laws in force in Monaco. Any legal pursuits will be directed to the courts of Monte Carlo, Monaco.
13. Changes to Terms
We may amend these Terms at our discretion. Any revisions will be publicized on our webpage with the updated modification date. Continuous use of our services post-modification equates to acknowledgement and acceptance of the new terms.
